1) About SendForge

SendForge is a business messaging platform that enables organizations to send and manage SMS and email communications. By using SendForge, you agree to these Terms.

2) Accounts & Eligibility

• You must be legally able to form a binding contract and comply with applicable laws.
• You are responsible for all activity under your account and for maintaining credential security.

3) Acceptable Use

• No spam, deceptive practices, harassment, or unlawful content.
• You must have appropriate consent for all outreach lists.
• You are solely responsible for compliance with messaging, privacy, and consumer protection laws (including but not limited to TCPA, CAN-SPAM, CASL, GDPR, and similar regulations).

4) Messaging & Carrier Compliance

Message delivery is not guaranteed. Carriers, email providers, and third-party platforms may filter, delay, or block messages. Use of SMS services is subject to carrier rules, industry guidelines, and telecommunications regulations, which may change. We may apply safety controls, rate limits, caps, registration requirements, or content restrictions to maintain compliance and protect the platform.

5) Suspension & Termination

We may suspend or terminate accounts that violate these Terms, applicable laws, carrier policies, or that create risk to the platform or other users.

6) Subscriptions, Billing, and Taxes

Paid plans authorize recurring charges until canceled. Prices may change; your checkout page confirms current pricing. You are responsible for applicable taxes.

7) Cancellation & Refunds

You may cancel at any time; access continues through the current billing period. Usage-based fees (e.g., carrier or email delivery costs) are typically non-refundable once incurred. See our Refund Policy for details.

8) Intellectual Property

SendForge and its underlying technology are owned by SendForge LLC. You retain ownership of your content and grant us a limited license to process it solely to provide the Services.

9) Indemnification

You agree to indemnify and hold harmless SendForge LLC and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services, including violations of messaging or privacy laws.

10) Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties.

11) Limitation of Liability

To the fullest extent permitted by law, SendForge will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

12) Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

13) Changes

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date.
